Army Charges Seven Paratroopers for Sex on Gay Site
RALEIGH, N.C. - According to an Associated Press report, the Army has charged seven paratroopers from the 82nd Airborne Division at Fort Bragg with "engaging in sex acts in video shown on a website."
Citing a statement released by military authorities, the AP reported that three of the soldiers face courts-martial on charges of sodomy, pandering, and engaging in sex acts for money. Four other soldiers received nonjudicial punishments. The Army has recommended that all be discharged.
According to the report, the three soldiers charged criminally had been appointed military attorneys. The nonjudicial punishment received by the four other soldiers includes "reduction to the rank of private, 45 days of restriction to the unit area, 45 days of extra duty, and forfeiture of a month's pay."
The report did not name the website, but it is unlikely that it is not ActiveDuty.com, the Dink Flamingo site that specializes in paratroopers and has an address in the vicinity of Fort Bragg.

Cobra Video Ratchets Up Offensive Against Underage Model
CHATSWORTH, Calif. - Claiming trademark infringement, breach of contract, violation of California statutes, and other injustices, Cobra Video LLC, through counsel Jeffrey Douglas, filed a federal lawsuit in San Diego, Calif., on February 7 against Sean Lockhart and others, seeking unspecified damages and injunctive relief.
Lockhart is the performer who appeared as Brent Corrigan in four Cobra Video titles while underage.
In a Feb. 13 press release announcing this latest lawsuit, Cobra Video stated, "Cobra Video alleges that Lockhart who had used Cobra's trade name 'Brent Corrigan' had misappropriated said name to compete in bad faith against Cobra Video. Defendant Lockhart had also alleged he used forged documents in order to work for Cobra Video in four productions which had been immediately removed from the market pending his actions."
Lockhart, through his attorney Chad Belville, says that the ID he presented to Cobra owner/director Bryan Kocis was forged and that he was 17 at the time the four videos were shot. Lockhart told GAYVN that he had performed in several additional videos for Cobra after he turned 18, but that Cobra does not have valid ID's for those movies.
Cobra's previous attempt to secure valid ID from Lockhart was a writ filed on October 27, 2005, in the Common Court of Pleas in Luzerne County, Penn., requiring Lockhart to appear on December 6, 2005, for a deposition and to bring a certified copy of his birth certificate with him.
Lockhart did not appear. On December 21, Belville told GAYVN, "Contrary to their claims, there is no actual lawsuit filed in Luzerne County, Penn. That state allows someone to get a case name and number without filing any claim, which is what Cobra has done, but issued a press release heralding their filing of a 'lawsuit' when in reality no claim has been filed.
"Cobra delivered a powerless piece of paper demanding that Brent fly across the country so that they could ask him questions, a procedure that is commonly done by telephone," Belville said. "Brent did not show up to the scheduled deposition because he was under no legal obligation to do so. Cobra has not even stated a claim other than silly demands for hundreds of thousands of dollars in lost revenues due to Corrigan telling the truth about his age. We believe they are just on a fishing expedition to get a copy of his real ID so they can release the latest videos."
In its press release announcing the federal lawsuit, Cobra states, "This asserts Cobra's zero tolerance policy for infringements of their business rights as well as those who would allege fraud and violate business practices. Cobra will pursue any and all who violate their rights, and engage in unfair business competition through all available legal means."
When contacted by GAYVN on February 22 for a response to Cobra's filing of a federal lawsuit against his client, Belville said, "Among other things, Cobra is suing a model for sending Cobra a PhotoShopped ID. The biggest problem with Cobra's case is that Cobra never inspected the actual ID, completely in violation of 2257. So, in order to prove their civil case they have to give factual evidence of a felony committed by themselves.

The Island: Day Four

Google Infringes On Nude Photo Site
NEW YORK (Reuters) - Google Inc.'s image search service violates the copyrights of adult magazine and Web publisher Perfect 10 Inc. by displaying thumbnail-sized photographs site, a federal judge has ruled.
However, Google is likely not responsible for displaying the underlying images from Perfect 10's Web site, a judge in the U.S. District Court for the Central District of California said in a ruling last week that was made public on Tuesday.
The order could effectively bar Google from featuring thumbnail pictures -- small versions of photos that are linked to a bigger version of the same picture -- but not limit Google from linking to actual photos which exist on other Web sites.
The judge accepted that people who click on full-size images from Perfect 10 are not viewing images that Google has stored or served up on its computers but links to other sites.
Google argued that its thumbnails constitute fair use.
U.S. District Court Judge A. Howard Matz ordered Google and Perfect 10 to develop a preliminary injunction that reflects both factors. His ruling was issued on Friday and released to the public on Tuesday.
"The court now concludes that Google's creation and display of 'thumbnails' likely do directly infringe P10's (Perfect 10's) copyrights," he wrote in the ruling.
Google expects to appeal an injunction if the judge issues one, the Mountain View, California-based company's litigation counsel Michael Kwun said in a statement.
"We anticipate that any preliminary injunction will have no effect on the vast majority of image searches, and will affect only searches related to Perfect 10," Kwun said.
Perfect 10 plans to appear at a court hearing on Wednesday to seek additional evidence to support its claims against Google, said company attorney Daniel Cooper.
"Everything that we tried to sell for a living, they were displaying for free," Cooper said.
Cooper said Perfect 10 is considering whether to appeal the judge's decision on Google and third-party sites.
Perfect 10 first sued Google and Amazon.com Inc., which runs the A9 Internet search engine and uses Google technology, in 2004. Matz said he would issue a separate order for Amazon.
In his ruling, the judge notes the value of Google image searches in simplifying and expediting access to information, but agrees that Google's use of thumbnails makes it a commercial consumer of Perfect 10's images. In particular, the Google-created thumbnails hurt Perfect 10's efforts to sell small images to mobile phone users, the judge ruled.
Beverly Hills, California-based Perfect 10 publishes photos of nude women in a magazine that sells for $7.99 per issue and at a subscription-based Web site that costs $25.50 per month.

Cruise Blasts Biographer's Gay Porn Mole
HOLLYWOOD - Tom Cruise is threatening to sue acclaimed biographer Andrew Morton after discovering he has hired a gay porn star to shed light on his private life.
Morton, who famously collaborated with Diana, Princess of Wales to pen an account of her life, has hired Los Angeles private investigator and former gay adult actor Paul Baressi to probe on-going speculation the Top Gun hunk is gay.

Viewing Porn At Your Local Library
BETHESDA, Md. - Two Montgomery County Homeland Security Officers were reassigned from their positions after they barred local library patrons from viewing Internet porn last week.
The two officers, whose identity was not disclosed, had overstepped their authority, Montgomery County Chief Administrative Officer Bruce Romer told the Washington Post today.
The men, who worked for the county's Homeland Security Department, had walked into the Little Falls Library in Bethesda on Feb. 9 and announced that the viewing of Internet porn was prohibited.
One patron who was apparently viewing online porn, was asked to step outside by one of the officers, according to a witness. But even after a police officer appeared and discussed the matter with those involved, no one was arrested or cited.
Romer said the two officers erroneously believed they were charged with enforcing the county's sexual harassment policy. Romer called the incident "regrettable" and "unfortunate."
The county’s sexual harassment policy bans the "display of offensive or obscene printed or visual material" in a county workplace like the county-run library. But since the library is also a public area, free speech guarantees in the U.S. Constitution would supersede the regulations, Romer admitted.
He added that the two security officers will be trained to better understand the harassment policy and residents' First Amendment rights.
The newspaper noted that the libraries in the area permit the viewing of porn, so long as the material is not offend others. To ensure that, libraries install a privacy screen.

French Connection to Distribute Amateur Straight Guys

South Korea's King and the Clown
SEOUL, South Korea (AP) - The latest hit movie in South Korea centres on an unlikely theme for the deeply conservative country: A delicately effeminate male clown caught between the affections of a despotic king and the love of a fellow performer.
King and the Clown has become an unexpected runaway success at the box office, drawing more than 8.6 million people - including President Roh Moo-hyun - since its Dec. 29 premiere, making it the third most popular film ever in South Korea.
The story involves a troupe of entertainers condemned to die for an act mocking the 16th century King Yonsan, but who beg to be pardoned if they can make the king laugh with their racy skit poking fun at him and his favourite concubine. The clowns succeed in breaking the king's icy stare and become court jesters.
Kong-gil, the gentle-faced male clown who portrays the female concubine in the act, draws the attention of the king and becomes his favourite - staging private puppet shows to Yonsan's delight but drawing the jealousy of clown leader Jang-saeng, who has always protected his friend from the amorous attention of other men.
The homosexual plot line is deliberately muted. The king and Kong-gil share only one quick kiss on screen.
The movie is based on a play that was inspired by a brief mention in the king's diary about his favourite clown.
Homosexuality has only recently gained some acceptance in South Korean society, with its strict Confucian traditions and a strong Catholic church. The government only in April 2004 removed homosexuality from a list of "socially unacceptable sexual acts" it considered harmful for youth.
Actor Hong Suk-chon caused a national sensation in 2000 when he became the first celebrity to publicly reveal he was gay. Hong's coming out cost him his job on a children's TV program, and he only returned to the small screen three years later - then playing an openly gay designer.
The new film was made on a low budget, ($4.5 million US), and unlike many other blockbusters doesn't deal with the tragic division of the Korean Peninsula.
Director Lee Jun-ik said he's been surprised by the success of King and the Clown, and feels it comes from the audience's enjoyment at seeing a window into palace life and the class contrast between the aristocracy and lowly clowns - not because of the homosexual theme.
Seeking to underplay the gay aspect, the film's English title is different from the Korean version that more directly implies the all-male love triangle: The King's Men.
"People who talk about homosexuality today have totally different concepts from the past," Lee told The Associated Press. He said the story of the relationship between the king and the clown was based on the tyrant's emotional emptiness that his concubine Nok-su is unable to fill - not physical desire.
The actor Lee Jun-gi who plays the clown Kong-gil has enjoyed a wave of attention from the film,
fuelled by the trend of "pretty boy" culture seen here in recent years of women favouring such androgynous men.Lee Jun-gi said one of the good things about the movie is that various interpretations are possible by the audience. "I feel proud of creating a unique character," he told AP.
"Lee Jun-gi's popularity is possible because he appealed to audience, not through homosexuality but as a 'pretty boy' without showing any homosexual desires," the Munwha daily newspaper wrote in a column analyzing the film's strong following.
"Korean society is still very closed, it's happening but not accepted," said Chung You-sun, 26, an office worker who saw the film with a colleague in downtown Seoul, adding that she was drawn by the satire of royal life.
Still, she said that the movie has garnered such wide popularity shows "Korean society is more and more open to homosexuality."
That's the hope of Hahn Chae-yun, director of the Korean Sexual Minority Culture and Rights Center, who also noted the touching story and film's direction were the real reason for its success - not the gay theme.
"I hope people's views toward homosexual love could be more broad-minded, and treated the same as love between others, through this success of the movie," Hahn said

Chi Chi LaRue Leaves Vivid
CHATSWORTH, Calif. - Director Chi Chi LaRue has stopped directing straight productions exclusively for Vivid Entertainment Group effective immediately due to Vivid changing its condom-only policy.
"I was scheduled to do a Savanna [Samson] movie and I was informed that the company is going condom-optional and that's absolutely their right and I totally understand it," LaRue told AVN.com.
